1. Agreement
These Terms govern your access to and use of Hospass, a host-funded hospitality service built at AI Garage. By creating an account, accepting a guest pass, or otherwise using Hospass, you agree to these Terms. If you use Hospass for an organization, you represent that you have authority to accept these Terms for it.
If you do not agree, do not use the service. Questions can be sent to hey@hospass.com.
2. Eligibility and accounts
You must be legally capable of entering into these Terms and provide accurate account information. Keep access to your email, Google account, devices, guest links, and connected provider accounts secure. You are responsible for activity performed through your account unless you promptly report unauthorized access.
3. The Hospass service
Hospass helps hosts configure hospitality events, invite guests, establish per-person limits and rules, coordinate provider-backed meal suggestions and ordering, review approvals, and maintain operational records. Features may be marked as preview, beta, simulated, or otherwise subject to limited availability.
4. Host responsibilities
Hosts and organizations are responsible for:
- Having permission to provide guest and team-member contact information to Hospass.
- Setting accurate event times, addresses, budgets, eligibility rules, and approval policies.
- Controlling who may use connected provider accounts and reviewing activity on those accounts.
- Paying provider charges and any separately disclosed Hospass fees.
- Handling tax, accounting, employment, safeguarding, and internal-policy obligations applicable to their events.
5. Guest responsibilities
A pass is personal to its intended recipient unless the host expressly allows transfer. Guests must provide accurate information, follow the host's budget and event rules, protect invitation links, and use provider services lawfully. A pass does not guarantee that a restaurant, menu item, delivery slot, or price will remain available.
6. Providers, orders, and payments
Third-party providers such as Swiggy are independent services governed by their own terms and policies. Availability, menus, pricing, taxes, delivery, cancellations, refunds, food quality, and safety are ultimately controlled by the relevant provider and merchant.
Hospass is designed to be non-custodial for food spending: host food funds remain within the host's provider or payment relationship, and Hospass does not hold a stored food-money balance. Depending on the provider flow, the host or provider account may be responsible for cash-on-delivery or other charges. Hospass may separately charge service fees if clearly disclosed before they apply.
7. Acceptable use
You must not:
- Use Hospass for fraud, harassment, impersonation, unlawful purchases, or unauthorized surveillance.
- Access another person's account, pass, provider connection, or organization without permission.
- Attempt to bypass budgets, approvals, security controls, rate limits, or provider restrictions.
- Upload malicious code, interfere with the service, scrape it at scale, or reverse engineer protected components.
- Use Hospass in a way that violates law or third-party rights.
8. Intellectual property and feedback
Hospass, its software, branding, interfaces, and original content are owned by AI Garage or its licensors. These Terms grant you a limited, revocable, non-exclusive right to use the service as intended. You retain rights in content you provide and grant us permission to process it to operate, secure, and improve Hospass. Feedback may be used without restriction or compensation.
9. Privacy
Our Privacy Policy explains how Hospass collects, uses, stores, and shares personal information and is incorporated into these Terms by reference.
10. Availability and disclaimers
Hospass is provided on an "as is" and "as available" basis to the extent permitted by law. We do not warrant uninterrupted operation, permanent availability of any provider integration, or that automated suggestions will always match a person's preferences, allergies, dietary needs, or event requirements. Users must independently review food, allergen, merchant, price, and order information before confirming an order.
11. Limitation of liability
To the maximum extent permitted by law, Hospass and AI Garage will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the service. Nothing in these Terms excludes liability that cannot legally be excluded.
12. Suspension and termination
You may stop using Hospass at any time. We may restrict or suspend access when reasonably necessary to protect users, providers, the service, or legal rights; respond to suspected misuse; or address a material breach of these Terms. Provisions that by their nature should survive termination will continue to apply.
Deleting an account is permanent. Organization owners must transfer ownership or use the available archive path before deletion. Deletion ends the person's access and removes or redacts personal profile and provider credentials, but it does not erase organization-owned events, orders, approvals, ledgers, reports, or security and audit evidence that Hospass or the organization reasonably needs to retain. Those records remain under an anonymized profile identifier as described in the Privacy Policy.
13. Changes and governing law
We may update these Terms as the service changes. The revised version will be posted here with a new update date, and material changes will receive additional notice when required. These Terms are governed by the laws of India, without regard to conflict-of-law principles, and disputes will be subject to courts of competent jurisdiction in India, except where applicable law requires otherwise.
